Terms of Service

Terms of Service

These Terms of Service govern your access to and use of Vismuse. By using Vismuse, you agree to these terms.

1. Overview

Vismuse is a creative workflow tool for generating and organizing social-ready content, including carousels, captions, visual prompts, AI-generated images and videos, audio, templates, edits, boards, libraries, and related creative assets. These terms form a binding agreement between you and Vismuse.

Last updated: October 18, 2026.

2. Eligibility and Accounts

You must provide accurate account information and keep your login credentials secure. You are responsible for activity that occurs under your account.

Some features may be available in guest mode. Guest workspaces, credits, prompts, uploaded assets, and generated outputs may be stored against a browser-based guest identifier. If you bind or sign in to an account, we may migrate eligible guest workspace data and credit history into that account.

3. Your Content

  • You may only upload, submit, or process content that you own or have permission to use.
  • You are responsible for the legality, accuracy, and rights status of your inputs and outputs.
  • You retain ownership of your content, subject to any rights required for us to operate the service.
  • You grant Vismuse the limited rights needed to host, process, transform, display, store, and transmit your content to operate and improve the service.

4. Acceptable Use

You agree not to use Vismuse to create, store, or distribute unlawful, infringing, deceptive, abusive, defamatory, or harmful content. You also agree not to interfere with the operation, security, or integrity of the service.

In particular, you may not use Vismuse to generate, request, upload, process, or distribute nude, semi-nude, sexually explicit, sexually suggestive, pornographic, or otherwise NSFW content. You may also not use the service to create exploitative sexual content, including content involving minors, non-consensual sexual content, or sexualized violence. We may remove such content and suspend or terminate accounts that violate this policy.

You may not use Vismuse to impersonate others, mislead audiences about material facts, violate platform rules, infringe intellectual property rights, or create content that you do not have the right to publish or commercialize.

Vismuse does not process, and you may not upload, request, create, alter, or otherwise process, IDs, passports, visas, visa support letters, immigration submissions, government or verification documents, official seals, licenses, certificates, or bank statements. You also may not use altered or fabricated transaction proofs, refund proofs, receipts, emails, chats, messages, or screenshots to falsify identity, authority, evidence, sender, content, timestamp, or transaction status.

Our Acceptable Use Policy forms part of these Terms and provides additional rules for AI-generated content, identifiable people, intellectual property, and prohibited uses.

5. AI-Generated Output

Vismuse uses automated systems to help generate and organize content. AI-generated output may be incomplete, inaccurate, or unsuitable for your intended use. You are responsible for reviewing all output before publishing, sharing, or relying on it.

AI image, video, audio, and copy generation may produce unexpected artifacts, similarities to existing works, or outputs that require additional rights review. You are responsible for checking generated assets before commercial use or distribution.

Vismuse is an independent product that may integrate third-party AI models and services. Vismuse is not affiliated with, endorsed by, or sponsored by the providers of those models unless we expressly state otherwise.

Video templates, reference footage, and soundtracks

Some video templates use footage, performances, scene references, or soundtracks selected by Vismuse, together with your photos and instructions. Depending on the template, reference material may be processed by a third-party AI provider, and a source soundtrack may be added to the exported video. Other templates generate new scenes or audio. The template description explains the intended workflow; an AI-generated result is not an authentic recording of the depicted person performing those actions or making those statements.

Vismuse is independent of the artists, performers, creators, record labels, and other rights holders referenced by trend names or templates. Unless expressly stated, they do not sponsor, endorse, or have an affiliation with Vismuse. References to their names identify the trend or subject and do not imply an official product, partnership, or endorsement.

Trend-template outputs containing third-party footage, performances, or source soundtracks are offered for personal, non-commercial entertainment and sharing only, subject to the rights needed for that use. Do not use these outputs in advertising, brand promotions, paid client work, resale, or monetized content unless you have independently secured all necessary permissions. This restriction applies to those third-party elements, not to all Vismuse creative tools or independently created assets.

Paying for generation, credits, or a download does not purchase a license to a third-party recording, composition, video, trademark, likeness, or voice. Neither a template being available nor a successful generation establishes that a particular use is authorized. Personal use, attribution, an AI label, or a short clip does not by itself establish permission. Third-party rights remain with their respective owners; these Terms do not grant rights we do not hold or limit any rights holder's claims against Vismuse. We remain responsible for our own conduct under applicable law.

Use photos and voices only with permission covering the requested AI processing and intended sharing. Do not present an output as a real performance or endorsement. Clearly disclose that realistic manipulated media is AI-generated and follow the destination platform's rules. Music permitted inside one platform is not necessarily permitted in downloads, advertisements, or posts elsewhere. We do not guarantee copyright protection, exclusivity, or third-party clearance for generated outputs.

Rights holders may report a template, reference clip, soundtrack, example, or generated output using the copyright and likeness reporting process below. We may restrict or withdraw affected materials and templates while reviewing a report.

6. Sharing and Public Libraries

If you choose to share, publish, remix, submit to a library, or otherwise make content public, that content may be visible to others. We may review, reject, remove, or moderate publicly submitted content at our discretion.

7. Third-Party Services

Vismuse may rely on third-party services for authentication, storage, analytics, payment processing, AI models, image generation, search or source retrieval, logging, advertising measurement, and infrastructure. Your use of Vismuse may involve those services processing prompts, files, generated outputs, account identifiers, usage events, billing metadata, and diagnostic information as needed to provide the product.

These providers may include AI model providers such as OpenAI and Google, payment services such as Stripe and Creem, hosting and application infrastructure such as Vercel, analytics or diagnostics services, and related subprocessors when those integrations are enabled.

8. Privacy and Data Controls

Our Privacy Policy explains how we collect, use, store, share, retain, and protect information. It also explains how to request access, correction, deletion, export, or other privacy controls where available.

9. Service Availability and Changes

We may update, modify, suspend, or discontinue features at any time. We do not guarantee that the service will always be available, uninterrupted, or error-free.

10. Plans, Billing, and Credits

If Vismuse offers paid plans, subscriptions, credits, or usage-based limits, you agree to pay all applicable fees and taxes. You may cancel a subscription at any time. Unless otherwise stated or required by law, cancellation takes effect at the end of the then-current billing period, you will keep access to paid features until that period ends, and you will not be charged for the next billing period.

You may request a refund within 7 calendar days of the applicable charge if paid credits and paid features have not been materially used. Material use includes any download after the applicable subscription charge or more than 5 paid generations. After material use, subscription fees, one-time purchases, paid unlocks, and credit purchases are generally non-refundable; cancellation ends future renewal and does not create a refund or credit for unused time or credits. We review verified billing errors, duplicate charges, and confirmed technical issues on a case-by-case basis. These rules, exclusions, and request process are set out in ourRefund Policy, except where applicable law requires otherwise.

You can manage or cancel an active subscription through the account or billing controls made available to you. If those controls are unavailable, contact support@vismuse.com from the email address associated with your account. For a billing, refund, or dispute question, include your account email and the relevant order or invoice reference. We will respond within three business days. If we approve a refund, we will complete processing it through the original payment method within five business days, subject to any additional time required by the payment provider or financial institution.

Credits are a limited right to access Vismuse services. They are not money, stored value, or a payment instrument; have no cash value; and may not be sold, transferred, exchanged, withdrawn, or redeemed for cash, except where required by applicable law.

11. Intellectual Property

The Vismuse software, branding, and original site design are owned by Vismuse or its licensors and are protected by applicable intellectual property laws. Third-party reference footage, soundtracks, performances, and other third-party materials remain subject to their owners' rights and the video template terms above. These Terms do not grant you ownership of the service itself.

12. Termination

We may suspend or terminate access to Vismuse if you violate these terms, create risk for the service or other users, or if we decide to discontinue the service. You may stop using Vismuse at any time.

13. Disclaimers

Vismuse is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

14. Limitation of Liability

To the fullest extent permitted by law, Vismuse and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of the service.

To the fullest extent permitted by law, our aggregate liability to you arising out of or relating to these Terms or the service will not exceed the greater of US $100 or the amount you paid Vismuse in the 12 months preceding the event giving rise to the claim. These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, or any liability that applicable law does not allow us to exclude or limit. Nothing in these Terms limits mandatory consumer rights or binds a third-party rights holder who has not agreed to these Terms.

15. Governing Terms

If any provision of these terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of that provision.

16. Copyright and Likeness Reports

Report suspected infringement involving any Vismuse template, source video, soundtrack, example, upload, or output to support@vismuse.com with the subject "Copyright report". No account or purchase is required. Identify the affected material with a page or file URL, template name, or other information that lets us locate it, and explain the rights involved. You may report platform-provided materials as well as user content.

Copyright notices

For a formal copyright notice, include:

  1. Your physical or electronic signature.
  2. The protected work, or a representative list of works, at issue.
  3. The allegedly infringing material and enough information to locate it.
  4. Your name, mailing address, telephone number, and email address.
  5. Your good-faith belief that the disputed use is not authorized by the owner, its agent, or law.
  6. A statement that your notice is accurate and, under penalty of perjury, that you are the rights holder or authorized to act for them.

People, voices, and misleading endorsements

If material uses your likeness or voice without consent, invades your privacy, or falsely implies your endorsement, email the same address with the subject "Likeness report". Identify the material, describe your connection to it, and explain the concern. You do not need to own the copyright to make this report. We may request proportionate information to verify the claim; do not send identity documents or sensitive information with your initial report.

Review and action

We review reports and may request missing information. We act expeditiously on sufficiently substantiated infringement notices, including removing or disabling access to affected material and, where appropriate, suspending the relevant template or source soundtrack. We notify affected users where appropriate and explain how to contest a decision. We terminate accounts of repeat infringers in appropriate circumstances. Reports about Vismuse-provided materials are reviewed directly rather than referred solely to the user who generated an output.

Our actions cover content and access we control; we cannot delete copies independently posted on another service. Report those copies to that service too. We may retain relevant records for complaint handling and legal obligations as described in our Privacy Policy. Notice details may be shared with the affected party when needed to process the dispute or required by law; counter-notices are forwarded to the original complainant.

Disputes and counter-notices

If you believe a removal was mistaken, reply to our notice with the material's location and your reasons. Where the U.S. DMCA counter-notice procedure applies, send your signature; identification and former location of the removed material; a statement under penalty of perjury that you believe in good faith it was removed through mistake or misidentification; and your name, address, and telephone number. Include consent to the jurisdiction of the Federal District Court for your address, or, if outside the United States, any judicial district where Vismuse may be found, and acceptance of service from the original complainant or their agent.

Under that procedure, we forward a valid counter-notice to the complainant and restore the material 10 to 14 business days after receiving it unless we receive notice of a filed court action seeking to restrain the alleged infringement. An independent privacy, safety, or other policy restriction may still prevent restoration. Copyright counter-notices do not resolve separate likeness or consent complaints. Knowingly misrepresenting infringement or mistaken removal may result in legal liability. Other jurisdictions' applicable reporting and legal requirements remain in effect.
